If NO set up their own company to handle their post-Hook income, he's not really entitled to any of that, less performance rights for his material, as Rob says.
I have to say though, I don't see much validity to the band's claim that he wants to rejoin New Order. Legal proceedings are not the best way to tell someone that you want to be part of their life again.

Yeah, I noticed the last time I saw them in October
Hooky's vocal has improved slightly, but not
great...there again hearing Barney in a live setting
isn't particularly great either. I think Hooky should
let Dave Potts (Pottsy) the guitarist sing more of the
songs, they have him singing on Perfect Kiss...https://www.youtube.com/watch?v=tT_XcA3wbLU and
he sounds incredibly like Barney.
When Hooky and Pottsy had their band Monaco there was
always the criticism that Pottsy sounded like Barney
therefore the shackles of NO similarity were there they just
found hard to shake.

As for New Orders album, personally I find it shocking,
truly shocking (well perhaps marginally better than Waiting
For The Sirens Call)...there again I have found NO to be a
mixed bag since 'Technique'. Seeing live footage
of them from Maida Vale for 6 Music as well as on youtube
they have somehow become dad rock and the worst tribute act
to New Order. I was embarrassed to hear one of my
favourite songs 'Lonesome Tonight' bastardised in
their live set.
Peter Hook & The Light do a far better job
with old New Order songs in my opinion, having dual bass
helps emulate the high and low bass patterns on a good
number of songs..
