Welcome back .... I also chilled for a few days over the weekend. I =
have seen much info from many of our counter-parts encouraging =
professionalism and legal action.
I stated my position last week when I said it would behove us all to =
wait for the official position which they have promised to have out by =
Tues or Wednesday of this week before we start any action. I believe it =
is reasonable to wait a day or two for the official stance since we will =
then be in a better position to address issues.=20
I did have a second conversation with Danny Nelms, In-Humane Resources =
today. He indicated that yes they were going to continue our pay as =
much as normal as possible (what ever that means) and no they still felt =
that we were to great a liability to service or deliver our policies =
after the 6/20 date. I have seen other emails asking why the Insurance =
Depts would be concerned with our plight. Basically they are not that =
concerned on behalf of the agents, but they do have major concerns when =
it comes to servicing policyholders. Their role after all is to protect =
the consumers primarily. I have asked Danny to address this issue very =
specifically in the meeting that he had scheduled today and to bear in =
mind, regarding liability, that LTPC had E & O insurance which protects =
us and them from time of sale through claim or cancellation, therefore =
any liability that we they perceive we pose is minimal.=20
In regards to communicating with either the State Insurance Department =
or the Department of Labor, one should keep copies of all correspondence =
and forward it as appropriate to the State of Tenn Insurance Department =
as well as the State of Tenn Department of Labor. However, until we =
have an official written position from Progeny I do not believe we can =
prepare a profession position based on fact not rumor. =20
I have seen many good ideas and suggestions, some more dramatic as =
others and I assure all that I share their concerns. However, I always =
believe that we accomplish more success in negotiating by selecting the =
top two or three issues and pursuing those collectively. I'm not sure =
that we are at that point yet. Additionally, I firmly believe that =
formal litigation will tie all of our money and hands up for many =
years.....so we may want to exercise caution in using this as a threat =
of action.
Again, welcome back and good job to both you and Doug for you =
coordinated efforts and deligence communication.

behove us all to wait for the official position which they have promised to have
out by Tues or Wednesday of this week before we start any action. I
believe it is reasonable to wait a day or two for the official stance since we
will then be in a better position to address issues. </FONT></DIV>

<DIV><FONT face=Arial size=2>I did have a second conversation with Danny Nelms,
In-Humane Resources today. He indicated that yes they were going to
continue our pay as much as normal as possible (what ever that means) and no
they still felt that we were to great a liability to service or deliver our
policies after the 6/20 date. I have seen other emails asking why the
Insurance Depts would be concerned with our plight. Basically they are not
that concerned on behalf of the agents, but they do have major concerns when it
comes to servicing policyholders. Their role after all is to protect the
consumers primarily. I have asked Danny to address this issue very
specifically in the meeting that he had scheduled today and to bear in mind,
regarding liability, that LTPC had E & O insurance which protects us and
them from time of sale through claim or cancellation, therefore any liability
that we they perceive we pose is minimal. </FONT></DIV>
<DIV><FONT face=Arial size=2></FONT> </DIV>
<DIV><FONT face=Arial size=2>In regards to communicating with either the State
Insurance Department or the Department of Labor, one should keep copies of all
correspondence and forward it as appropriate to the State of Tenn Insurance
Department as well as the State of Tenn Department of Labor. However,
until we have an official written position from Progeny I do not believe we can
prepare a profession position based on fact not rumor. </FONT></DIV>
<DIV><FONT face=Arial size=2></FONT> </DIV>
<DIV><FONT face=Arial size=2>I have seen many good ideas and suggestions, some
more dramatic as others and I assure all that I share their concerns.
However, I always believe that we accomplish more success in negotiating by
selecting the top two or three issues and pursuing those collectively. I'm
not sure that we are at that point yet. Additionally, I firmly believe
that formal litigation will tie all of our money and hands up for many
years.....so we may want to exercise caution in using this as a threat of
action.</FONT></DIV>
