To all LTPC Alums.=A0 First legal opinion.
Today I received the first legal opinion about our termination from LTPC.=
=A0=20
After they researched this with the information I sent them, such as contrac=
ts,=20
alum emails, and just a general letter explaining everything as concisely as=
=20
possible this is what they say.=A0 This legal opinion was given by an attorn=
ey=20
that specializes in employee employer disputes and corporate law.=A0=20
The attorney's believe at this time that there is a case, but it will depend=
=20
on several things.=A0 Also the type of case and how to go about it.
1.=A0 Believe that there is a whole host of misrepresentations.
2.=A0 Need to find out what was Progeny's intent.=A0 Was it a legitimate=20
downsizing, or was it done to maximize profits?=A0 This is a key as to how t=
o proceed.
3.=A0 Have misrepresentations for sure at this point in lost time for=20
employees.=A0=20
4.=A0 Need to have proof, a smoking gun if Progeny decided to close a year=20
ago.=A0 Several people tell me this is true.
5.=A0 Need people to come forward to say that they were in a meeting, had a=20
discussion, saw a memo, have a memo that LTPC was going to close months befo=
re it=20
did.
6.=A0 People will have to come forward and say they were told to keep quiet=20
about this.=A0 Agents, managers that were aware of this will have to be will=
ing to=20
give testimony.=A0 This will come out in discovery.
7.=A0 Even if it is not in writing that is OK, just the fact that discussion=
s=20
were being held or there was talk about this at meetings is good enough.=A0=20
8.=A0 Were there agents that knew about this a year ago and made plans to go=
=20
into brokerage?=A0=20
9.=A0 Need to contact those agents and employees that are not on this site.=
=A0=20
Even agents that were only with the company a short time.=A0 Those hired rec=
ently=20
and then let go.=A0=A0 Those that were in home office, the support staff.=
=A0 Maybe=20
they knew of what might have been going on.
10.=A0 There is a case.=A0 At minimum without any more evidence then we curr=
ently=20
have, they say we should go to the Labor Administration about unfair labor=20
practice, they will pursue the case for us.
11.=A0 There is a powerful case, a class action suit against Progeny that ca=
n=20
be made if we can produce some evidence proving misrepresentation.=A0 What w=
as=20
their intent?=A0=20
12.=A0 The law firm that gave me the opinion will not be the one handling th=
e=20
case.=A0 They advise we get a large law firm that specializes in employee cl=
ass=20
action lawsuits. A giant killer.=A0 =20
They are will help in looking for one.
13.=A0 In their opinion if we have evidence, we should have no problem getti=
ng=20
a firm to represent us in a class action suite.=A0=20
14.=A0 This law firm should take this on a contingency basis because of the=20
size ans scope.=A0 Again if we can supply some evidence.=A0 Again a memo is=20=
good,=20
verbal will do.
There is a case.=A0 It just depends on what type of a case we have.=A0 If an=

has this type of evidence now is the time to come forward.=A0 At least with=20=

acknowledgment that you have something or can contribute something.

like if you were close and then just lost thousands each year for you and yo=
