Rick,

I wanted to make you aware of a situation regarding LTPC and how they're =
performing on their obligation to have contact with the client in lieu =
of the agent.  Today I received a call from a client that I submitted =
applications for, to LTPC prior to 6/20.   The client told me that since =
receiving her policy, she had some questions regarding an outstanding =
delivery requirement.  Along with the policy, was a letter that said, =
that if there were any questions to call LTPC and speak with Jennifer =
Hardin.  It has now been 2 weeks since the clients original call to =
Jennifer Hardin, and so far, no return.  When the client called again, =
she was told to contact her agent.  I then called LTPC to speak with =
Jennifer Harding directly, but was told that she was not available and =
they didn't know where she was, or if she was even in today.  My client =
needs answers to her questions and no one is taking care of this.  I =
spoke with Barbara Garby at LTPC, and basically was not able to give me =
any time period as to when the client would receive a return call.  LTPC =
seems to have no answers to how they are handling our clients.  It is a =
bad reflection on us, as the agent of record, especially where they =
could recommend us to other potential clients.  We need to be assured =
that these issues are taken care of and, if not us, who?  LTPC?  It =
doesn't look like it. =20

  Articles talk about what rights you might have after termination.  =
Below are some of the articles main points.  Whether you are vested or =
not I would like some comments about these issues.  They should be =

  1.  Possible right to replace business if it meets state law governing =
replacement and you improve your clients position. =20

  2.  Possible that agency contracts should not interfere with special =
agent client relationship.

  3.  Possible according to article that even vested agents might not =
forfeit renewals if helping client.

  4.  Possible that contracts might not be enforceable due to different =
state laws.

  5.  Possible if agent did a good job he owns a relationship with =
client.

  6.  Possible departing agent not paid for service to client this may =
represent a subsidy to insurance company.

  7.  Possible that clients have a different opinion of us now that we =
are terminated.  Company might have embarrassed us if notifying clients =
that we are no longer able to serve them.   They might have damaged our =
reputation.
